Some in the legal community and lawmakers on Capitol Hill are now examining whether to take that power away. Judges might not be the best people to determine whether they should recuse themselves from cases, said U.S. Rep. Hank Johnson, a Georgia Democrat who recently held a congressional hearing on the issue. The plain language of the statute does not include a penalty, and under the established rules of statutory construction, words used in a statute must be given their natural, plain, ordinary and commonly understood meaning, wrote Ben Baxley, chief of the Opinions Division for the Alabama Attorney General s Office. Kelvin Pell, Cpl.
